1. Acceptance of These Terms
These Terms of Use govern your use of www.straightflushconstruction.com (the "Site"), operated by Straight Flush Construction Services LLC ("Straight & Flush," "we," "us," or "our"). By using this Site, submitting a form, or enrolling in our text message program, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old to submit information through this Site.
2. SMS PROGRAM TERMS AND CONDITIONS

Program description. By providing your mobile number and checking the consent box on any form on this Site — or by giving verbal or written consent to a Straight & Flush representative — you agree to receive text messages from Straight Flush Construction Services LLC relating to your inquiry, appointment, or project. Messages may include inspection and appointment confirmations and reminders, crew and material delivery updates, requests for documents or approvals, estimate and agreement delivery, project status updates, follow-up after completion, and occasional service reminders or promotional offers.
Consent is not a condition of purchase. You are not required to agree to receive text messages in order to receive an estimate, purchase any goods or services, or otherwise do business with Straight Flush Construction Services LLC.
Message frequency. Message frequency varies and depends on your project activity. You may receive several messages during an active project and few or none otherwise.
Cost. Message and data rates may apply. Straight & Flush does not charge for text messages, but your mobile carrier's standard messaging and data rates apply. Contact your carrier for details about your plan.
How to opt out. You may cancel at any time by replying STOP to any message from us. You will receive a single confirmation message and will not receive further texts unless you opt in again. You may also opt out by calling (256) 755-4944 or emailing corey@straightflushconstruction.com.

Supported carriers. Message delivery is supported on major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, US Cellular, and others. T-Mobile is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages.
Delivery. We cannot guarantee that every message will be delivered. Delivery depends on factors outside our control, including carrier network conditions and your device.
Privacy. Mobile phone numbers and text-message opt-in data are never shared or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
3. Estimates, Proposals, and Pricing on This Site
Any pricing, price range, product information, or example project shown on this Site is for general informational purposes only and is not an offer, quote, or binding price. Actual pricing depends on measurements, site conditions, product selection, and scope.
No work is authorized and no price is binding until both parties have signed a written agreement. Verbal statements, website content, text messages, emails, and preliminary estimates do not create a contract.
Written estimates we provide are valid for the period stated on the estimate document. Where anything on this Site conflicts with a signed agreement, the signed agreement controls.
4. Warranty Information
Product and warranty descriptions on this Site are summaries. Manufacturer warranties are governed solely by the manufacturer's own written warranty terms and require proper registration and an approved installation. Our workmanship warranty is stated in your signed agreement and is governed by that document, not by this Site.
5. Project Photography
We photograph job sites for documentation, measurement, warranty, and quality-control purposes. We may use project photographs in marketing materials, on this Site, and on social media. When we do, we remove or crop identifying details such as house numbers, license plates, and faces. If you prefer that photographs of your property not be used in marketing, tell us in writing and we will honor it.
6. Accuracy of Information You Submit
You agree that information you submit through this Site is truthful, accurate, and your own, and that you are authorized to provide any property address or contact information you enter. Do not submit another person's mobile number for text messaging without their consent.
7. Intellectual Property
All content on this Site — including text, photographs, graphics, logos, the "Straight & Flush" name and mark, and the tagline "40 Years of Frame to Finish!" — is owned by Straight Flush Construction Services LLC or used with permission, and is protected by applicable law. You may not copy, reproduce, or use it without our written permission. Third-party manufacturer names, logos, and product marks are the property of their respective owners.
8. Third-Party Links and Services
This Site may link to or embed third-party services, including scheduling tools, financing partners, and manufacturer resources. We do not control those services and are not responsible for their content, availability, terms, or privacy practices.
9. Disclaimer
This Site is provided "as is" and "as available." We make no warranties of any kind regarding the Site, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Nothing on this Site is legal, insurance, financial, or engineering advice. Insurance claim outcomes, financing approvals, and insurance premium reductions depend on your carrier, lender, and circumstances, and are never guaranteed by us.
10. Limitation of Liability
To the fullest extent permitted by Alabama law, Straight Flush Construction Services LLC is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of this Site or your reliance on its content. Our total liability arising from your use of this Site will not exceed one hundred dollars ($100.00). This section does not limit any obligation under a signed construction agreement, which is governed by its own terms.
11. Indemnification
You agree to indemnify and hold harmless Straight Flush Construction Services LLC and its owners, employees, and subcontractors from any claim arising out of your misuse of this Site or your submission of information you were not authorized to provide.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of this Site will first be subject to good-faith negotiation. If unresolved, the dispute will be settled by binding arbitration in Madison County, Alabama, under the rules of the American Arbitration Association.
13. Changes to These Terms
We may revise these Terms at any time. The current version is always posted on this page with its Effective Date. Continued use of the Site after a change constitutes acceptance.
